Terms of Service

These Terms of Service ("Terms") govern the relationship between Joyboy Media (Pty) Ltd ("Joyboy Media", "we", "us") and you ("Client") when you engage our digital marketing services. By signing up or proceeding with any paid package, you agree to these Terms.

1. Services Provided

Joyboy Media provides digital marketing services including, but not limited to: social media management, paid advertising management (Meta and Google), content creation, SEO and blog writing, email marketing, and website/app design and development.

The specific services delivered to each Client are determined by the package selected at time of engagement and any written agreements (including WhatsApp messages) confirming scope.

2. Packages and Pricing

Package Monthly Fee Summary
Chart the Course R0 (7-day trial) 2 sample posts, branded graphics, 1 strategy call. No payment required.
Set Sail R999/month 4 posts/month, 1 platform, branded graphics, monthly report.
Full Speed Ahead R1,999/month 8 posts/month across all social platforms, active community management, a detailed report, Meta Ads management for client spend up to R3,000, and 1 SEO blog. Google Ads are not included.
The Grand Line R5,999/month 16 posts/month across active platforms, Meta and Google Ads management, 2 SEO blogs, email automation, and dedicated account management.

Website and app builds are priced separately as once-off projects and quoted individually. All prices are in South African Rand (ZAR) and exclusive of VAT unless otherwise stated.

3. Payment Terms

Monthly retainer fees are due in advance at the start of each billing cycle. Joyboy Media will issue an invoice via email. Services for the upcoming month will commence upon receipt of payment.

For once-off website and app builds, a 50% deposit is required to begin work, with the remaining 50% due upon delivery of the final product before handover.

Late payments may result in a suspension of active services until the account is brought up to date.

4. Advertising Spend

Where advertising management is included in the selected package, the monthly fee covers our strategy, setup, management and optimisation. Client media spend (also known as advertising or ad spend) is separate and paid directly by the Client to Meta or Google. Joyboy Media will recommend a suitable budget based on your goals but will not be held liable for platform performance or spend that is outside our direct control.

5. Cancellation and Contract Duration

All monthly packages are month-to-month with no minimum lock-in period. Either party may cancel the agreement with 30 days' written notice. Notice should be provided via email to rahulseerand@joyboy-media.co.za.

Upon cancellation, all work in progress during the final paid month will be completed and delivered. No refunds are issued for the current billing month once services have commenced.

6. Revisions and Scope

Each piece of content (post, graphic, blog, ad copy, etc.) includes up to 2 rounds of revisions. Additional revision rounds beyond this are billable at R250 per round. Significant changes in brief or direction after work has commenced may be treated as a new scope item.

The following are not included in any package unless explicitly agreed in writing:

7. Intellectual Property and Asset Ownership

Upon full payment, the Client owns all brand-specific creative assets produced for them (logos, custom graphics, written copy, and campaign materials). Joyboy Media retains the right to use templated designs, workflows, and proprietary systems developed internally.

Social media account login credentials remain the property of the Client at all times. Joyboy Media does not take ownership of any Client account.

Joyboy Media may use anonymised campaign results and non-confidential creative work as portfolio references or case studies unless the Client requests otherwise in writing.

8. Results Disclaimer

Digital marketing results depend on numerous factors outside our control, including but not limited to: market conditions, audience behaviour, platform algorithm changes, ad spend levels, and the quality of the Client's product or service. Joyboy Media makes no guarantees of specific follower counts, leads, sales, or return on investment. Past results achieved for other clients are illustrative only and not a promise of similar outcomes.

10. Confidentiality

Both parties agree to keep confidential any sensitive business information disclosed during the engagement. This obligation survives termination of the service agreement.

11. Limitation of Liability

To the maximum extent permitted by South African law, Joyboy Media's total liability to the Client for any claim arising from the services shall not exceed the total fees paid by the Client in the 3 months preceding the claim. Joyboy Media is not liable for indirect, consequential, or special damages including lost profits or lost data.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Gauteng, South Africa.

13. Amendments

Joyboy Media reserves the right to update these Terms at any time. Clients will be notified of material changes via email. Continued use of our services after notification constitutes acceptance of the updated Terms.
